("the Company") operates the online teacher matching service ("Service") through our official website (e.g., https://speakbeyond.online/ and other regional websites operated by the Company) and applications under the brand name "Speak Beyond". This Privacy Policy governs the collection, processing, and use of all personal information in connection with your use of our Service.


If you ("the Member(s)") are a minor, we kindly ask you to carefully read and discuss this Privacy Policy with your parent or legal guardian prior to using the Services. 1.1.3 To conduct business activities as described in the business registration or Articles of Incorporation, and to comply with legal obligations.


1.2 The legal basis for processing your personal information by the Company includes (a) your informed consent to the processing of your personal information for specified purposes outlined in this Privacy Policy, (b) the performance of duties required by the teacher matching service contract with you, (c) fulfillment of legal obligations such as maintaining relevant invoice and accounting records for tax purposes, and (d) maintaining service quality and protecting the rights of data subjects.

2.1 "(Speak Beyond) use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.” 


2.2 Our website and applications may contain links to third-party websites, such as the payment interface provided by our authorised payment partner, or the external meeting tools company (Lessonspace). 2.3 When you download lesson recordings or receive files containing the personal information of third parties through our Service, you assume control over such personal information processing activities, which are not covered by this Privacy Policy. It is important to be aware that if your processing activities extend beyond personal or domestic purposes, you may be subject to liabilities and obligations imposed by applicable personal information protection regulations.

3.1 The Company may utilize website analytics technologies to automatically gather information about your browsing activities on the website. However, if you have not registered as a Member of our Service, your activity records will not be linked to personally identifiable information.


3.2 During the registration process, the Company may collect personal information that you voluntarily provide, such as your name, gender, age, photo, country, mobile phone number, email address, and payment information.


3.3 The Company may collect information related to your time zone, language proficiency, lesson scheduling, teacher evaluations, communication with teachers via our Service, reported issues, surveys, referral programs, and relevant usage during your use of our Service. With your consent, the Company may record the content of individual lessons you take for future use.


3.4 The Company will record the lessons with the objective of ensuring the quality of the course and mitigating potential disputes. If both Student Member and Teacher Member provide consent for lesson recording and permit downloading, Student Member may obtain the recording for post-lesson review. In cases where Student Member consent to lesson recording but Teacher Member does not consent to video downloading, the Company will retain the course video solely for backup purposes. Access to this file requires consent from both parties or a valid reason. The lesson recording function is enabled by default but can be disabled when booking individual courses. If Teacher Member choose to keep this function enabled, Student Member consent to lesson recording will be assumed. The video capture settings will be remembered for future sessions.   1. Retention period and the geographic region in which we use your personal data

4.1 The Company will retain your personal information for the duration necessary to fulfill the purposes mentioned above. Your personal information may be processed and stored in the geographic regions where the Company conducts its business operations, including Malaysia, other service locations of the Company, and regions where our outsourced partners are located.



  1. Who will receive your personal information?

Your personal information will only be shared with third parties with your consent or for the purpose of information processing by partners contracted by the Company to perform the contractual obligations. The recipients of your personal information are further detailed as follows:


5.1 Partners commissioned by the Company to provide identity authentication services (e.g., Google Sign In, Facebook Sign in, and Apple Sign In), payment services, provider of the website technical solutions, and web hosting platforms.


5.2 The Company will provide the serial number and amount of your purchase order to its payment service provider partner to facilitate the completion of online payment through their services. Upon placing an order, you will be redirected to the payment service provider's hosted payment interface. Please note that all payment processing will be handled by the payment service provider, and the Company does not store credit card or payment method information.


5.3 The Company utilizes website administration tools, such as Google Analytics (inlcuding Google Tag), to enhance website analytics and design. Our Privacy Policy applies to all matters not mentioned or specified in this Supplemental Statement.


The processing of your personal information by the Company serves the purpose of providing you ("Teacher Member(s)", or "Teacher(s)") with the online teacher matching service ("the Service"). To ensure the efficient matching of teachers with learners, the Company collects and processes information pertaining to your profile picture, educational background, qualifications, resume, biography, certificates, self-introduction video, demonstration video, and other relevant reference materials. These details are utilized to facilitate the accurate and effective matching of teachers with potential learners, thereby enhancing the overall quality and efficacy of the teacher matching service.


  1. Usage of your confidential information

1.1 The Company will compile and display your personal information and learner reviews in your profile on our website, allowing learner to search and find their best match to their learning needs.


1.2 The Company will display your profile (including, but not limited to, your profile pictures, introduction video, and biography, etc.) on the Facebook, Instagram, Twitter,  Xiaohongshu or Youtube channels it manages and serve advertisements to our target audience and followers for marketing purposes.


1.3 The Company may contract with an advertiser, such as Google, to display your profile (including but not limited to your photographs, video, and written introduction, etc.) on the social media managed by the Company (e.g., business pages on Twitter, XiaoHongShu, Facebook and Instagram), to serve advertisements to our target audience and followers on these platforms for marketing purposes. 


1.4 The Company may enter into agreements with advertisers, such as Google, to display your profile, including your photographs, videos, written introduction, and other relevant information, on designated advertising pages of partner websites accessible to users for marketing purposes.

  1. Lesson Recording 

2.1 In order to ensure the quality of the Service, optimize its operation, and facilitate dispute resolution between both parties during the course, the Service includes a simultaneous recording function. When learners choose to enable the course recording and you grant them permission to download the course video, both parties may download the relevant course video within the specified timeframe following the course. If learners choose to enable the lesson recording function but you deny them the ability to download, the Company will store the course video solely for backup purposes. Any request for access to this file must be made with the agreement of both parties or for a valid reason. The Company will not use the video for any purposes not specified in our Privacy Policy or this Supplemental Statement.


2.2 You acknowledge and agree that the Company may randomly review the course video or conduct a review of the lesson recording in response to a specific issue reported regarding abnormal practices, in order to ensure that Teacher Members do not engage in criminal activity through our Service and to discourage inappropriate behavior during the lesson. 

 

2.3 Automatic recordings will be generated for each lesson conducted on Speak Beyond. By entering the classroom and initiating the lesson, you provide consent for the platform to record the session. These recordings will remain confidential and will not be disclosed to the public or any unauthorized individuals.
